General Terms of Service for the Use of the EDITIVE GmbH website and applications

Thank you for your interest in our website editive.com and our services. Please read these General Terms of Service carefully before using this website and the Services. By using our website and our services you confirm that you’ve read and accepted our Terms of Service and Privacy Policy.

1. Scope of application

1.1 The General Terms of Service apply between you (hereinafter referred to as “user”) and EDITIVE GmbH (hereinafter referred to as “EDITIVE”) for all types of use of our free and paid services on the webpages, e.g. editive.com and blitzcompare.com, such as blog article retrieval and web applications, which are made available by EDITIVE via the internet addresses cloud.editive.com. They apply equally to each of these EDITIVE services, unless special terms and regulations are expressly made for a particular type of service or a provision or regulation obviously does not concern a particular type of service.

1.2 EDITIVE offers the use of the web pages to the user under the condition that the user agrees to these general Terms of Service. The user has no entitlement to use the web pages or the services.

2 Contents and services

2.1 EDITIVE offers users information, articles and services on the topic of enterprise content collaboration and text comparisons. This includes, for example, the service of entering texts into the HD-Diff algorithm to obtain visual text comparisons.

2.2 Even though most content and services are free and open to everyone, the following General Terms of Service must be observed. In general, registration is not required to use the content. For certain services (e.g. newsletter), registration is required in order to receive further information and functionalities. Although EDITIVE makes every effort to ensure the accuracy of the information and visualizations of the text comparisons in the HD-Diff, EDITIVE does not guarantee or warrant the accuracy or completeness, factual correctness or reliability. The content and services on this website are therefore provided “as is” without warranty or guarantee of any kind. The user should always check the services professionally.

2.3 Internet use (for example, by an access provider) regularly incurs costs. These costs are borne by the user, they are not covered by EDITIVE.

2.4 EDITIVE is free to design the contents and services and is entitled to change, restrict, discontinue or extend the offered contents and services at any time.

3 Documents

3.1 If you use the EDITIVE Text comparison and collaboration products, only upload documents that you want to transfer to our servers. This document transfer step is necessary to provide our service.

3.2 EDITIVE’s free comparison service which does not require any registration processes the texts of the uploaded documents solely for the purpose of analyzing text differences. The uploaded documents will not be stored on the server beyond the duration of the analysis.

3.3 EDITIVE’s service offered on cloud.editive.com only saves the documents if the user explicitly uploads them.

4 Access to the web pages and to the services

4.1 EDITIVE does not guarantee the constant and uninterrupted availability of web pages and the services. However, EDITIVE endeavors to keep the web pages and services available to the user 24 hours a day.

4.2 The EDITIVE web pages and services are usually updated at certain intervals, however, the user has no right to an update. EDITIVE reserves the right to restrict the operating hours or to suspend them for a temporary period for technical reasons – for example, due to maintenance work. Furthermore, EDITIVE reserves the right to make technical changes to the website and the services. These changes apply in particular if they are necessary for technical reasons or due to mandatory legal requirements.

5. Changes of these general Terms of Service

EDITIVE reserves the right to amend, change or adapt these General Terms of Service, which can be viewed, saved and printed out at any time on the website www.editive.com under the menu item “Terms of Service”, in particular in order to adapt them to new legal regulations as well as technical developments. In these cases, EDITIVE will also adapt the information on data protection accordingly. Therefore, as a user, please note the current version of our Privacy Policy and our General Terms of Service.
